ActiviTee Terms of Use

1. Purpose and scope The application helps clubs organise and follow sporting activities: schedules, training, competitions, results, educational content, communications and documents, according to the features made available by the club. These terms govern personal use of the service. They are separate from the commercial contract between ActiviTee and the club, the club's rules and the rules specific to sporting activities. The club contract covers, in particular, the annual licence and its billing; these terms cover access and use by people assigned an account. Any specific rules of a sporting organisation are presented to you in the relevant context. 2. Accounts and fees Junior, Parent and Coach accounts are created exclusively by authorised club staff. These users cannot register themselves. The account and available features depend on the assigned role and associations; platform administration has a process for managing authorised accounts. The club purchases and pays for an annual ActiviTee licence. Juniors, parents and coaches are not required to take out an individual ActiviTee subscription. Any club membership fees and fees for training or competitions are set by the club independently of this licence. Accepting these terms does not require these users to pay ActiviTee. 3. First use and minors Applicable documents are presented on first use and whenever a new decision is required. The club's creation of an account does not constitute acceptance by the user. For a child, the representative's authorisation is obtained separately for that child and club, in accordance with the applicable rules on capacity and representation. The parent accepts their own terms and makes a separate decision for the child. The junior also receives information suited to their age. At launch, users under 18 follow a process supported by a verified representative. This process does not remove any rights a minor can exercise personally according to their capacity for discernment. If age or representation is uncertain, the club checks the situation before opening the relevant features. A disagreement between representatives is examined before disputed use resumes. At 18, the terms and representatives' access are reviewed; an earlier authorisation does not automatically become the player's personal acceptance. 4. Account security and information Use the access assigned to you personally. Keep your password confidential and do not sign in as someone else to make a decision for them. A parent uses their own representative access. Tell the club about an incorrect association, lost access or suspected misuse. Provide accurate information and report anything that needs correction. The club verifies the roles, associations and permissions under its management. Being able to help recover an account does not authorise anyone to accept a document or give parental authorisation in place of the account holder. 5. Messages, documents and conduct Respect other users, their privacy and their rights. Do not send harassing, discriminatory, threatening, illegal or irrelevant content. Do not publish another person's data, photographs or documents without authority to do so. Limit personal information to what is needed and check who can see a section before posting. You retain your rights in your content. You permit its hosting, display and transmission to the extent necessary for the requested feature and its intended audience. This permission is not a general licence to use your image for advertising or to send your data to a partner. It ends with the relevant use, subject to the retention needs explained in the privacy notice. You can report content or conduct to the club manager or to info@activitee.golf, giving enough information to identify it. The club and operator examine the matter within their respective responsibilities, may restrict access to disputed content and take appropriate action. A report does not authorise general disclosure of information about the people concerned. 6. Sporting organisation and Marketplace The club and its staff organise activities and validate sporting information. Check instructions and changes communicated by your club. The application does not replace on-site safety instructions or direct contact in an emergency; assessments and digital assistance are not medical advice. The Marketplace is for giving away, selling or exchanging golf equipment between families of the relevant clubs. ActiviTee connects people: it does not collect payment for a transaction or charge a commission. The price, payment, handover and other terms of a sale or exchange are agreed directly between the parties. Hosting a listing does not make ActiviTee or the club the seller of the equipment. A representative must take part in a minor's transaction. Describe the condition of equipment honestly, state clearly whether it has a price or is free, and list only items you are entitled to dispose of. Illegal, misleading or non-golf-equipment listings may be removed after review. The rights and obligations of the transaction parties still apply; the platform offers no additional guarantee for the equipment. 7. Availability, support and liability The service may be interrupted, including for maintenance or technical difficulties. For questions about your activity, access or information entered by the club, contact the club. Technical support, content reports and personal-data requests can be sent to info@activitee.golf. This address is not an emergency service. ActiviTee takes reasonable measures needed for the operation and security of the service. The club remains responsible for organising sporting activities and for the accuracy of information it provides; users are responsible for their own acts within the limits of applicable law. Uninterrupted operation and any particular sporting result are not guaranteed. Each party's liability remains governed by applicable law, without a general exclusion or a waiver of users' mandatory rights. 8. Optional features and personal data The privacy notice explains data processing. Reading it does not amount to agreement to every use. AI assistance using a player's data is optional and requires a separate choice; sporting follow-up remains available if it is refused. At launch, ActiviTee does not plan commercial communications or public publication of photographs of people. A change to those uses would require information and appropriate choices before implementation. Information needed for club life and account security is separate from commercial communications. 9. End of access, suspension and changes A change of club, role or permission can change access. Suspension must be linked to an identifiable reason, including security, misuse or loss of necessary rights, and limited to what is necessary. An explanation and a way to request review must be provided unless a restriction is justified. The club reviews decisions about its access and content; the operator handles platform security and operation. An urgent measure may precede the explanation if needed to protect people or the service. You may request a review from the club or at info@activitee.golf. Refusal in one club does not automatically suspend separate access in another; a measure concerning account security may, however, affect the whole account. Leaving a club, withdrawing an authorisation, closing an account and deleting data are separate operations. Effects on other clubs, possible retention obligations and third-party rights must be considered. You can ask for your situation to be reviewed through the means stated in the privacy notice. A new version of the terms is identified and accompanied by a summary of changes. When a new acceptance is requested, an earlier decision does not count as acceptance of the new text. A refusal is explained with its consequences and access to help and rights-exercise channels. Past decisions retain the text to which they relate. 10. Applicable law and resolution of difficulties These terms are governed by Swiss law, subject to applicable mandatory provisions. The competent courts are determined by law. Seeking an amicable solution with the club or operator does not deprive the user of legal remedies. 11.
